This document covers the (I) Terms and Conditions of Use, as well as the (II) Privacy and Information Use Policy of the Maria Cecilia Souto Vidigal Foundation (“Foundation”), which guides navigation and regulates the use of the Foundation's websites (“Websites”) and their content, for any purpose, and govern the access to and exploitation of information and any content made available therein and at other website addresses related to or to which the User may be directed.

By reading and accepting the terms set forth herein, by means of navigation, prior registration to receive a newsletter, and access to the available content, the User expressly declares being aware and in accordance with the established conditions and authorized uses, including the corresponding personal data and information you provide.
 

I. Terms and Conditions of Use
 

1. Compliance with Terms and Conditions of Use. The Foundation works to promote the development of early childhood development, articulating actions in favor of children, from birth to six years of age.

2. Privacy and Use of Information. Access to and use of the Content set forth below, browsing the Websites, and using our services is subject to the Foundation's Privacy Policy.

3. Websites’ Content and Offered Services

3.1 To disseminate information that contributes to a better understanding of Early Childhood Development, the Foundation makes available and provides materials and information on this topic, produced in Brazil and abroad, either by the Foundation or by third parties, through its Websites (“Content”).

3.1.1 The Content made available by the Foundation is free for Users. However, the Foundation requires a previous and simplified registration to enable access to the Content.

3.1.2 If you would like to receive our news, fill out a simple registration by providing your e-mail or activate the option “I accept to receive newsletters of content selected by the Foundation” when you register.

3.2 The Foundation will ensure keeping the material and information contained on the Websites complete and up-to-date. However, it will not be responsible for the use, application, or processing that Users may make to the Content, the User being solely and entirely responsible for the purpose and use, regardless of nature, of the Content collected from the Websites.
 

4. User Registration and Authentication

4.1 The User, to use the services (described in item 3.1.1 above), must have legal capacity for civil acts and must provide the required registration information, assuming full responsibility (including civil and criminal) for the accuracy and veracity of the information provided therein.

4.2 In the event of incorrect, untrue, or unconfirmed information, the Foundation reserves the right not to complete the ongoing registration or to block the existing registration, preventing the User from accessing our Content or receiving our newsletter until, at the Foundation's discretion, the aberration is regularized. The Foundation also reserves the right to prevent, at its discretion, new registrations, or cancel those already made, in case a serious aberration is detected or demonstrates a deliberate attempt to circumvent the rules described herein as obligatory for all Users, and will act in the same manner if the User fails to comply with any obligation set forth herein.

4.3 Upon successful registration, the User will have access to the desired Content, and if they choose to receive our updates, they may be sent to the email address registered by the User at any time.
 

5. User Obligations

5.1 It is the User's obligation to provide precise and accurate registration information, being solely and entirely responsible (in all legal aspects) for all content that they have provided in each registration field.

5.2 You accept and acknowledge that your use of the Websites and the Content will be under your sole and exclusive responsibility.

5.3 By using the Websites, The User undertakes to:

  • To use the Websites and their Content in accordance with the law, good manners, public order, the general principles of law and the provisions of this Term;
  • Do not use the Websites and their Content in a manner that is harmful to the Foundation's purposes, or in any way that causes damage, renders useless, impedes or overloads the normal use of the Websites and their content;
  • Ensure the accuracy of the information provided to the Foundation;
  • Refrain from manipulating or deleting the authorship credits of Content made available on the Websites.

5.4 The User will be liable for damages and losses of any kind whatsoever suffered by the Foundation as a result of the breach of any of their obligations under these Terms.
 

6. Foundation Obligations

6.1 Unless otherwise specified on the Websites, the Foundation grants the User, duly registered, authorization to:

(I) view and download the Content in the exact terms made available on the Websites for strictly personal, non-commercial use; and

(II) reproduce, publicly display, and distribute the material obtained on the Websites for non-commercial purposes,

provided that the User preserves, in all copies of the material, all authorship credits, copyright notices, and other notices of ownership/material integrity contained in the original material.

6.2 Protect the confidentiality of all User information and records using storage on servers or any other high-security magnetic means. However, it will not be liable for the repair of damages that may be derived from the seizure and cooptation of data by third parties who breach security systems and are able to access this information.
 

7. Amendments and Modifications to the Terms and Conditions of Use

7.1 The present Term may, at any time, have its content, or part thereof, modified and amended by the Foundation for improvement.

7.2 In the event of material changes, the Foundation will post a notice on the Websites along with the new version of this Term so that the User can evaluate the amendments before continuing to use the Websites. In the event of objections to any amendment, the User may express his opposition, provided he does so in writing, to the email address fmcsv@fmcsv.org.br, and may request the cancellation of his registration and sending of our newsletter at any time.
 

8. Channel of Communication

8.1 To establish contact between the Foundation and the User, the e-mail address fmcsv@fmcsv.org.br is made available, to be certain that the User is equally obligated to maintain an updated email address for the sending of communications from the Foundation since it lends itself legal validity and effectiveness to this electronic means of exchanging reciprocal information.
 

9. Acceptance of the Terms of Use

9.1 You, the User, declare you have read, understood, and agree to all rules, conditions, and obligations set forth in these Terms and Conditions of Use.
 

10. Copyright and Intellectual Property

10.1 The Websites contain text, photographs, images, and sound that are protected by copyright or other Intellectual Property rights.

10.2 By accessing the Websites, you declare that you will comply with these Terms and Conditions, as well as any other intellectual and industrial property rights that may or may have been otherwise available on the Websites.

10.3 No content may be reproduced in any form by any means except as expressly permitted in this Term, under penalty of the civil and criminal liability of the User.
 

11. Links to other sites

11.1 The Websites provide links to third party websites. The Foundation, however, is not responsible for the privacy, security and content policies of such sites and cannot be held responsible for any claims, losses, or damages suffered as a result of the use of such links. We recommend that you read the Terms and Conditions of Use and the Privacy Policy of any site before you start browsing.
 

12. Trademarks, patents, software, and any other intangible assets, whether registered with the Foundation or not.

12.1 The brands and other distinctive signs, patents, software, logos, and any other intangible assets of the Foundation, whether registered or not, used on the Websites, are the sole and exclusive property of the Foundation and its respective owners. The User has no right to use or exploit them in any way whatsoever. This Term does not guarantee any right to use and/or exploit for any purpose any trademarks, distinctive signs, or any other rights of exclusive ownership of the Foundation without the prior written permission of the Foundation or the respective right holder.
 

13. Indemnity and Limitation of Liability

13.1 The User agrees to attest to the Foundation's innocence against any and all third party claims, and is liable for damages, losses, and expenses (including any applicable official fees and costs and appropriate professional/attorney's fees) arising out of its use of the Websites, as well as any materials, content, or information it submits to the Websites.

13.2 In no event shall the Foundation or its partners be liable for any direct, indirect, intentional, or accidental damage, including any loss of profits or revenue, cost of property replacement, loss or damage to information arising from misuse or inability of the User accessing the Websites or any site linked to them, or for any act resulting from browsing the Websites and/or otherwise exploiting material displayed on the Websites, whether based on warranty or justification, even if the Foundation or its partners are advised of the possibility of such damage.
 

14. Applicable laws and venue

14.1 Any and all questions regarding access to and use of the Websites shall be governed by the federal laws of Brazil and the laws of the State of São Paulo. The parties elect the District Court of São Paulo - SP as competent to settle any disputes that may arise from the interpretation and fulfillment of this Term.

II. Privacy Policy and Use of Information.

Your privacy is very important to the Maria Cecilia Souto Vidigal Foundation (“Foundation”). Accordingly, we have developed a Privacy Policy in accordance with the General Data Protection Act (Law No. 13718/2018), which provides for how we collect, use, disclose, transfer, store, and delete your information on our Websites.

1. What and why we collect User Information

Please be advised that we collect some data from Users of our Websites to provide an informational service, and this policy describes how this is done.

You may be required to provide timely personal information at any time while you are contacting the Foundation or browsing its Web sites. The Foundation may share this information and use it in accordance with this Privacy Policy. The Foundation may also combine this information with other information to improve our services, information, and content.
 

2. What personal information do we collect

When you register through our Websites, you become a Registered Foundation User, and we may obtain some necessary and required information, including your name, e-mail address, area of expertise, and interest group (third sector, entrepreneur, student, others).
 

3. How we use your personal information

We may process your information for the purposes described in this Privacy Policy with your consent, to comply with legal obligations to which the Foundation is subject, or when we believe that disclosing it is necessary for the legitimate interests of the Foundation or third parties.

The information we collect (in some cases, in conjunction with non-personal information) enables us to keep you up-to-date and to provide Users with better use of our websites. For example:

Communication. We may use your personal information to send newsletters, as well as educational materials and dissemination for Foundation activities. If you no longer wish to participate in our mailing list, you may opt-out at any time via the unsubscribe link found at the bottom of the email that is sent or by submitting an unsubscribe request by to e-mail fmcsv@fmcsv.org.br.

From time to time, we may use the information you provide to send important notices, such as policy and condition announcements. In these cases, as the information is important to your interaction with the Foundation, you may not choose not to receive it.

Aggregate Data. We may also obtain information about the User activities on our site. This information is aggregated and used to help us understand which parts of our websites are of most interest, to improve your security, and to improve our content. Aggregate data is considered non-personal information for purposes of this Privacy Policy.

Statistical data. We also use the information collected for study and statistical purposes and to improve all content provided by the Foundation – such as articles, books, brochures, presentations, scholarly papers, newsletters, videos – (“Content”), as per preferences and audience profiles. Aggregate data is considered non-personal information for purposes of this Privacy Policy.
 

4. Collection and use of non-personal information

We also collect data that, independently analyzed, does not allow direct association with a specific individual and is considered non-personal information. We may collect, use, transfer, and disclose such non-personal information for any purpose and the purposes set forth in this Privacy Policy.

If we combine non-personal information with personal information, the combined information will be treated as personal information as long as that information remains combined.
 

5. Cookies and other technology

Foundation Websites, email messages, and Content may use "cookies" and other technology such as pixel tags. This technology helps us better understand User behavior by telling us which parts of our websites people have visited. We treat information obtained through cookies and other technology as non-personal information. However, to the extent that the Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we will also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for this Privacy Policy.

As with most websites, we get some information automatically and store it in log files. This information includes IP addresses, browser type and language, Internet service provider (ISP), lookup and exit pages, operating system, date and time information, and click sequence data.

We use this information to understand and analyze preferences, administer the site, learn about User behavior on the site, and obtain demographic information about our user base in general. The Foundation may use this information in our outreach services.

In some of our email messages, we use a "click-through URL" linked to the Foundation's website content. When Users click one of these URLs, Users are sent to a different web server before reaching the landing page on our site. We monitor this click-through data to understand the interest in certain topics and to evaluate the effectiveness of communications with our Users. If you prefer not to be monitored this way, do not click text or image links in email messages.

Pixel tags allow us to send email messages in formats that Users can read and tell us whether or not the email has been opened. We may use this information to reduce or eliminate messages sent to Users.

At any time, if you no longer wish to receive future contacts via email, request to unsubscribe.
 

6. Information Storage

The information we collect is stored in a reliable system and is usually used by technology companies located in Brazil.

In hiring these systems, the Foundation always seeks companies that employ best practices in the security of their information storage, establishing contracts that do not violate the privacy definitions provided in this Policy.

How long is the information stored?

The Foundation stores the information it collects for as long as necessary for the purposes set forth in our Terms and Conditions of Use and this Privacy Policy, respecting the data retention period determined by applicable law.

If you request the deletion of your registration, we will take all necessary steps to, within a reasonable period from the date of the request, promote the definitive deletion of data and information made available and collected by the User, in compliance with current legislation.

In some cases, we may retain your information even if you delete your account, such as in the case of mandatory record-keeping under applicable law, if there is an unresolved issue related to your account (such as a complaint), or if necessary for our legitimate interests, such as fraud prevention and security enhancement for our Users.
 

7. Disclosure to third parties

Service Providers. We may use third parties and individuals to perform Website-related activities, including, but not limited to, service maintenance, database management, data analysis, and feature enhancement. These companies or individuals have or may have access to User information to perform tasks/routines on our behalf and are required not to use or disclose such information for any other purpose.

Social Networking Services. We allow Users to connect their social networking services accounts to our websites. Users may, at their discretion, share our Content on their social networks, provided that they comply with the conditions and obligations set forth in the Terms and Conditions of Use, notably with respect to the related Intellectual Property Rights and which fall within the Content made available on the Websites.

Others. The Foundation may be required by law, process, litigation, and/or determinations by public or governmental authorities within or outside the country in which you reside to disclose any information collected. We may also disclose such information if the Foundation understands that such disclosure is for national security, legal requirements, or other matters of public importance or when disclosure is necessary or appropriate. The Foundation also safeguards its ability to disclose and use such information to enforce the Terms and Conditions of Use or to protect our operations or its Users.
 

8. Protection of Information Collected from Users

The Foundation takes precautions, including administrative, technical, technological, and physical measures, to protect the information collected against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction.

We only handle User data by implementing industry-leading security best practices for data protection. However, it is not possible to completely guarantee the non-occurrence of interceptions and breaches of the Foundation's systems and databases, since the internet has its security structure under constant improvement. In any event, the Foundation is committed to always striving to mitigate and resolve any incidents that may occur when collecting and storing User data.
 

9. Targeting other sites and services

Our websites contain links to third party websites. If you choose to visit another website by clicking a link, you will be redirected to the third party website. Redirecting to a website is not an endorsement, authorization, or representation of an affiliation with that third party, nor is it an endorsement of its privacy or information security policies or practices. We do not exercise control over third party websites and advise you to read the privacy policies and terms of use before providing any information or using other websites.
